FMCSA's CDL Requirement Proposal
The Federal Motor Carrier Safety Administration published on February 2, 2024, a notice of proposed rule-making. The proposal will affect CDL requirements, and truckers along with other stakeholders will have until April 2, 2024, to let the agency know how the changes will affect the industry and safety.
The American Trucking Association (ATA) and the New Hampshire Department of Transportation prompted proposed changes, according to the FMCSA. The FMCSA asserts that the planned modifications to requirements aim to enhance flexibility for both state driver licensing agencies and applicants.
CDL Requirement Changes
- Applicants will be given the opportunity to take a CDL skills test in a state that isn’t their home state
- Commercial learner’s permit holders who have passed the CDL skill test will be allowed to operate commercial motor vehicles on public roads, without a qualified CDL holder in the passenger seat
- The applicant will no longer be required to wait at least 14 days to take the CDL skills test after the initial issuance of a commercial learner’s permit
- Mandating that third-party knowledge examiners adhere to the training, certification, and record-check standards currently in place for state knowledge examiners

These changes, as reported by the FMCSA, are asserted to have no adverse impact on safety. The agency's statement indicates a proposal aimed at enhancing the efficiency and convenience of obtaining a CDL by introducing flexibilities in specific licensing processes while maintaining a commitment to safety. Additionally, the proposed changes are designed to fortify the program integrity of CDL knowledge tests conducted by third-party examiners and offer increased flexibility for CDL holders engaged in transporting empty passenger Commercial Motor Vehicles.
